Referral program terms

1. The program

• The HolaMaya Referral Program is run by HolaMaya Real Estate, Calle 125 Norte, Ejidal, 77712 Playa del Carmen, Quintana Roo, Mexico ("HolaMaya", "we").
• It rewards people who introduce new clients who buy or sell a property through HolaMaya in the Riviera Maya, including Playa del Carmen, Tulum and Cancún.
• Anyone aged 18 or over can take part, including real estate professionals. HolaMaya employees and their immediate family are not eligible.

2. Qualifying referrals

• The person referred must be a new client: someone who has not contacted HolaMaya, been introduced to us or worked with us in the 12 months before your referral.
• The referral must be submitted through the form on the referral program page, or confirmed in writing (email or WhatsApp) by the HolaMaya team.
• You confirm that the person referred agreed to be contacted by HolaMaya.
• A referral stays valid for 12 months from the date we confirm it. If the transaction closes within that period, the reward applies.
• If the same client is referred by more than one person, the reward goes to the first referral confirmed by HolaMaya.
• You cannot refer yourself, your spouse or a company you control.

3. Reward amount

• Buyer referral: 20% of the commission HolaMaya receives on the purchase.
• Seller referral: 10% of the commission HolaMaya receives on the sale of the property, when HolaMaya sells it.
• The reward is calculated on the commission actually received by HolaMaya, net of taxes (including VAT/IVA) and of any part paid to other agencies or brokers. When a transaction is shared with another agency, the percentage applies to HolaMaya’s part only.
• Commission rates vary by property and transaction, usually between 3% and 6% of the price. Amounts shown in the calculator are estimates for illustration only.
• Rental referrals are not covered automatically. Any reward for a rental must be agreed in writing before the lease is signed.

4. Payment

• The reward is paid within 30 days after HolaMaya receives its commission, once the sale has closed at the notary or, for pre-sale properties, when the developer pays the agency.
• If HolaMaya receives its commission in several instalments, the reward is paid in proportion to each instalment received.
• Payment is made by bank transfer in US dollars or Mexican pesos. We may ask for your identification, tax details or an invoice (factura) before payment.
• Taxes may be withheld when required by Mexican law. You are responsible for declaring and paying any tax due on your reward in your country of residence.

5. When no reward is due

• No reward is due if the transaction does not close, is cancelled, or if HolaMaya does not receive its commission.
• If a commission is refunded or cancelled after a reward was paid, the corresponding reward must be returned.
• HolaMaya may refuse a referral in case of fraud, misleading information, spam or behaviour that harms the agency or its clients.

6. Your role

• You act independently. You are not an employee, agent or representative of HolaMaya and cannot make offers, promises or commitments on our behalf.
• Sharing HolaMaya’s listings or brand must stay accurate and must not use paid advertising on the HolaMaya name without our written consent.

7. Personal data

• We use the information you send us only to contact the person referred, manage the referral and pay your reward, as described in our privacy policy.

8. Changes and applicable law

• HolaMaya may modify or end the program at any time. Referrals confirmed before a change keep the terms in force on the date they were confirmed.
• These terms are governed by the laws of Mexico. Any dispute falls under the jurisdiction of the courts of Playa del Carmen, Quintana Roo.
